These Terms of Service ("Terms") govern your access to and use of PinScene ("Company," "we," "us," or "our") and the website located at https://pinscene.com (the "Website").

By accessing or using the Website, you agree to be bound by these Terms of Service, our Privacy Policy, Disclaimer, and Data Use Policy. If you do not agree to these terms, you may not use the Website.

Eligibility

You must be at least 18 years old to use the Website. By using the Website, you represent and warrant that you meet this requirement.

Nature of the Service

PinScene provides a real-time, community-driven map where users post short-lived "pins" describing local events, incidents, and happenings. All information is provided for general informational purposes only.

We do not provide emergency, medical, legal, financial, or public-safety advice. Users should independently verify any pin content before relying on it, and should always contact appropriate authorities in emergencies.

We reserve the right to modify, suspend, or discontinue any feature or aspect of the Website at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of services.

User Accounts

Certain features require account registration. You agree to provide accurate and complete information, maintain the confidentiality of your login credentials, and accept responsibility for all activity under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or pose security risks.

Third-Party Authentication

Users may log in using third-party services such as Google, Facebook, or Apple. By doing so, you authorize us to access limited profile information as permitted by that provider. Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for third-party authentication systems or interruptions in their service.

User-Submitted Content

Users may post pins containing text, categories, locations, and optional photos, and may submit reactions, reports, and profile information. By submitting content, you represent that you have the right to share it, grant PinScene a non-exclusive, worldwide, royalty-free license to use, display, modify, aggregate, and analyze the content in connection with the service, and acknowledge that submitted content may be combined with other data and displayed in aggregated or derived form.

We reserve the right to remove content that is inaccurate, misleading, unlawful, abusive, spam, or otherwise in violation of these Terms.

Content Accuracy Disclaimer

Pin content is user-generated and may also include aggregated data from public feeds or third-party providers (for example, weather alerts, traffic notices, and event listings). We do not guarantee the accuracy, completeness, or timeliness of any content displayed. Use of the Website is at your own risk, and you should never rely on PinScene as a sole source of information during an emergency.

Acceptable Use

You agree not to use the Website for unlawful purposes, attempt to gain unauthorized access to systems, interfere with security or platform integrity, scrape, copy, or redistribute data without authorization, submit false, misleading, fabricated, or harmful pins, impersonate others, post content that is defamatory, harassing, hateful, threatening, sexually explicit, or otherwise inappropriate, or use automated tools to submit content or interact with the Website without prior written consent.

We may suspend or terminate access for violations.

Sponsored Pins and Business Accounts

PinScene offers a paid product called Sponsored Pins through which advertisers can create geographically targeted campaigns. Business account holders agree to provide accurate advertiser information, comply with all applicable advertising laws, and follow our advertising policies. Sponsored Pins are clearly labeled. Payments are processed by Stripe and are subject to Stripe's terms. Refunds, cancellations, and campaign management are governed by the terms presented at checkout and in the business dashboard.

Intellectual Property

All Website content, including logos, branding, software, design elements, and proprietary systems (including PinScene's pin grouping, scoring, and ranking logic), are owned by or licensed to PinScene and protected by intellectual property laws. You may not reproduce, distribute, reverse engineer, or exploit content without written permission.

Advertising and Monetization

The Website may display advertisements (including Sponsored Pins and third-party ad networks) or affiliate links. We may receive compensation from third parties. We do not guarantee the accuracy of third-party offers and are not responsible for third-party products or services.

DMCA Copyright Policy

PinScene respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. Our designated copyright agent is:

Submitting a Takedown Notice

If you believe content on the Website infringes your copyright, please submit a written notice to our designated agent that includes all of the following:

  • Identification of the copyrighted work you claim has been infringed
  • Identification of the material you claim is infringing, with sufficient detail for us to locate it (for example, the specific URL or pin ID)
  • Your contact information, including name, address, telephone number, and email address
  • A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf
  • Your physical or electronic signature

Please be aware that knowingly submitting a false or misleading takedown notice may expose you to liability under 17 U.S.C. § 512(f), including damages, costs, and attorneys' fees.

Counter-Notice

If you believe content was removed in error, you may submit a counter-notice to our designated agent that includes:

  • Identification of the material that was removed and the location where it appeared before removal
  • A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification
  • Your name, address, telephone number, and email address
  • A statement that you consent to the jurisdiction of the federal district court for your judicial district, or if outside the United States, any judicial district in which PinScene may be found, and that you will accept service of process from the person who submitted the original takedown notice
  • Your physical or electronic signature

Valid counter-notices will be forwarded to the original complainant. Content may be restored within 10 to 14 business days unless the complainant files a court action seeking to restrain the restoration.

Repeat Infringer Policy

In accordance with the DMCA and applicable law, 7H Ventures LLC maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers.

Limitation of Liability

To the fullest extent permitted by law, PinScene, 7H Ventures LLC, and their owners, operators, affiliates, and contributors shall not be liable for any direct, indirect, incidental, special, consequential, or financial damages, including but not limited to loss of profits, business opportunities, data inaccuracies, service interruptions, personal injury, or unauthorized access to user data, arising from or related to your use of the Website or reliance on any information provided.

Your use of this website is at your sole risk.

Our total liability to you for any claim shall not exceed $100.

Disclaimer of Warranties

The Website is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy or reliability.

Indemnification

You agree to indemnify and hold harmless PinScene, its affiliates, officers, and employees from claims arising out of your misuse of the Website, your submitted content, your violation of these Terms, or your violation of applicable laws. This obligation is limited to claims arising from your own conduct and does not extend beyond what is reasonable under the circumstances.

Privacy and Data Rights

Your use of the Website is subject to our Privacy Policy and Data Use Policy. For residents of certain jurisdictions, including California and the European Economic Area, additional data rights may apply under CCPA, CPRA, or GDPR. Users may request deletion of their account and associated personal data by visiting the Data Deletion page or contacting [email protected].

Termination

We reserve the right to suspend or terminate access at our sole discretion, including for violations of these Terms. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, DMCA, and governing law survive termination.

Governing Law and Venue

These Terms shall be governed by and interpreted in accordance with the laws of the State of Georgia, without regard to conflict of law rules. This section applies only when arbitration is unavailable or inapplicable, including for users who have validly opted out of arbitration, claims eligible for small claims court, and requests for emergency injunctive or equitable relief. In such cases, disputes shall be resolved exclusively in the state courts of Gwinnett County, Georgia, or the United States District Court serving Gwinnett County, Georgia. You irrevocably consent to the exclusive jurisdiction and venue of such courts.

Dispute Resolution, Arbitration, and Class Action Waiver

Mandatory Binding Online Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, the Website, or services provided by PinScene shall be resolved exclusively through final and binding online arbitration, rather than in court, except that you may assert claims in small claims court if they qualify, or seek emergency injunctive relief in a court of competent jurisdiction to preserve the status quo pending arbitration.

Arbitration shall be conducted through New Era ADR under its applicable online arbitration rules, and shall be conducted remotely via written submissions, video conference, or other electronic means. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration provision. Judgment on the arbitration award may be entered in any court of competent jurisdiction in Gwinnett County, Georgia.

Informal Resolution Requirement

Before initiating arbitration, the parties agree to attempt to resolve the dispute informally by contacting [email protected] and providing a written description of the issue. The parties agree to engage in good faith discussions for at least 30 days before commencing arbitration.

Class Action Waiver

You agree that any dispute resolution proceedings shall be conducted only on an individual basis and not as a class, consolidated, representative, or collective action. You waive any right to participate in a class action lawsuit, class-wide arbitration, private attorney general action, or any other representative proceeding. The arbitrator may not consolidate claims of more than one individual and may not preside over any form of representative or class proceeding.

Waiver of Jury Trial

To the fullest extent permitted by law, you and PinScene knowingly and voluntarily waive the right to a trial by jury in any legal proceeding arising out of or relating to these Terms or the use of the Website.

Arbitration Costs

Each party shall bear its own attorneys' fees and costs unless otherwise required by law. Administrative fees shall be allocated in accordance with the rules of New Era ADR. PinScene reserves the right to subsidize reasonable administrative fees to ensure accessibility of the arbitration process.

Opt-Out Right

You may opt out of the arbitration and class action waiver provisions by sending written notice within 30 days of first accepting these Terms to [email protected]. Your notice must include your name, the email address associated with your account, and a clear statement that you wish to opt out of arbitration. If you opt out, the Governing Law and Venue section shall control.

Changes to Terms

We may modify these Terms from time to time. For material changes, we will notify registered users via email prior to the change taking effect. Continued use of the Website after updates constitutes acceptance of the revised Terms.
